Unless the person is actively claiming to be you (and not just uploading your pictures and adding your friends) instagram cant do anything about it. its not against the law to take someones public photos and upload them to their account. otherwise fan accounts wouldnt be a thing for example.

lesson of the day: don't expect privacy when you upload pictures on the internet to your public accounts. it may suck but thats the reality of social media. better safe than sorry
