If they directly took it from a picture of the shirt and pasted it in then whoever made the original can take VP to court for copyright infringement. 
However if the item was made from scratch with inspiration from something in real life like a shirt, nothin can legally be done.

That's how Zara can steal from independent artists and get away with it. They make slight changes and it's 100% legal.
