Not if only the eye shape was the same no lol, its extremely hard finding an original eye shape that still will look normal-sized 
if it looks literally the same then its still stealing
everyone draws eyes different, more or less similar to others, but if it looks just the same theres no way anyone can defend that

The eyes look vaguely familiar i think on a skin i once saw. they look a bit like myung.

in this case Freckle posted a design of her own as comparison
I'll take a further look at it, but for now it's done, like we could delete the new set, but I doubt that would make people happy about it
but yeah, when it comes to the facial features, it is difficult at times to be really unique

(throwback at the time Lily's skins made even me take a second look at them to find out if it was one of hers or one of mine)

The shape, shadow in the cornes, eyelashes and even the pixels in the iris/pupil is the same, u can see it's copied and altered for sure
